How Do I Find Out If My Mobile Disco Name Is Already Taken.

hi there i was wondering how to find out if the mobile disco name that we are about to call ourselves is already taken.

where can we find this information out. also will it cost us anything to trademark our name.

I guess it depends on what you want to do.

 

There is as far as I know, nothing to stop you calling yourself anything you like, regardless of who esle may be called it. Unless.... it's been registered by companies house. This is generaly done when forming limitted companies (and to be honest there is really no point going to that expense for a mobile disco). You can easily search the register at companies house (you will neeed to find them by doing a google search, I can't recall there web address) to see if anyone has registered your name, if not, you will be fine. As I said, if it's not registered and someone else is using it, the only thing stopping you from using it as well is your own peace of mind. Unfortunately a name not registered with companies house will onl;y be found by a little legwork, search engine trawling etc....

 

As for registering your name once you decide on it, it is certainly possible to do that with companies house without becoming a linitted company. It's not free and it does involve a small amount of annual paperwork, but I believe you can "hold" names for a while - 3 or 5 years I think?

 

When considering registering a name, be careful with things that are too similar as companies house I believe will refuse some names if they are too close to other companies. Once they say no, your stuffed! So, calling a company Boot the chemist or British Telecoms or even Asda's would be a no go (simply example's I'm afraid).

What name are you intending to use?

With the many contacts on here, I'd say this is a good place to start - let us know the proposed name and we'll give you an opinion.

 

Don't worry about hitting on a name used by someone else; Unless they are in the same line of business and relatively near you, it really won't matter.

 

Once you've made a reasonable effort to ensure no-one else is using the same name as you, get a website up as this in itself will go a fair way to ensuring your name isn't copied by someone else in the future, by virtue of the exact steps you are now taking.

I would say, do a GOOGLE Search of what you want to call yourself and if nothing comes up, away you go, not too sure about the trademark bit mind

No point in trademarking your name. Unless you might possibly be going multi-national, which I doubt.

 

Just register with HM Revenue as a sole trader - all they'll want is your name for this, although they may note down a business name if you have one.

 

But it looks as though there are two of you running the show at the moment;

From experience I'd say that's a dodgy way to work things, and complicates the running of the business a lot. Far better if you can decide which one of you is actually going to run the business, and then pay the other a wage.

 

Operating a partnership for a disco business is not a good idea because of the inevitable split in profits which may not be that great anyhow, the need for a solicitor to draw up a partnership contract and the possibility (probability?) that you will fall out at some point.

 

Go it alone, and do not take on another guy just because you don't have the confidence at the moment - it will be a millstone around your neck. With experience comes confidence - you don't need anyone to hold your hand in this manner.

 

If you really are pooing yourself at the idea of doing a disco alone (and most of us did), then maybe one of the guys on here (depending on your area) may pop along to guide you and keep you company for a roadie's fee or less for your first few gigs.

as it's been said in earlier feeds it dont matter.

If you call yourself something then find out there's another company with the same name it dont matter so long as its not the same as a company in your region.

For instance i started using ads.entertainments bout 5 years ago and if i hadn't found this forum i'll neva of known their was another ads entertainments based down south.

Lets face it unless your looking at national domination which many of us arn't your never likely to cross your namesake 200 miles away

Technically...put the name into this search tool from companies house. If it doesn't come up you're allowed to use it.

More realistically (assuming you are not going for nationwide coverage) - look in your thompson local / Yellow pages. If it's there then i wouldn't advise using it (although perfectly legal), if not then go for it.

Actually, even getting around a name already registered at Companies House is child's play.

 

So you want to register the name My Disco, and its taken.

So you could register a company called:

My Disco (UK)

My Disco (International)

My Disco (Luton)

 

and so on.

All above would be accepted by CH in the face of the existing registration.

If you wanted to protect a name, you could always register a domant company with companies house (i.e. it doesn't physically trade), but you'd still be able to trade as a sole trader under the name of Yourname t/a disconame.

 

Somewhere like UKplc could do the registration for you fairly cheaply..
