after just reading a similar thread about being told to stop etc

 

i was booked to do a 40th Birthday at a local hotel, they initially said it would be 8-12, so i quoted X amount. A week later the birthday boys wife called up to say they had got a 1am extension, would this affect the price? I said yes it would be an Extra £X amount, they agreed and paid in full a week before the event

 

On the evening it was hard work and there was certainly an atmosphere, approx 11:30 an arguement kicked off, no security in the building, so the party stopped and that was that. Suddenly im faced with a Dilemma, do i say nothing, pack up and leave? Do i offer to give the money back for the extra hour? (which i havnt worked). Then if i am asked for the money back, do i say yes or no?

 

Now, ive only had a couple of occasions (in 11years) when trouble has forced the end of the night so suddenly. In those instances, ive told myself that i was booked 8-12 and i gave a price for the evening so if the party finishes early, ive been paid for the night. However in this instance they were clearly aware of how much that extra hour cost them, would they be entitled to the money back?

Correct, thats exactly what I would do!

 

Its not your fault that the party has finished early due to a fight.

What would you do if a party finished due to a fight just 30 minutes after starting and you still have 4.5 hours to play, would you give them 4.5 hours worth of their money back?

I certainly wouldnt.

Don't even think about refunding. it's their fault the party ended early not yours. They simply booked an extension and didn't use it.

i'd be surpised if they ask for there money back. it was beyound your control so don't worry about it

Not a chance. They booked you for the night, and the got you for the night. If you had to stop early due to your equipment failing or a family emergency, fine - give them a refund. But for something that isn't your fault - don't give them a penny. You've given up your time, you were willing to stay until the agreed end time but were forced to stop early due to ther factors. I wouldn't dream of giving them a penny back.

Just spoken with my bank manager, and explained that I had to refund someone because there was a fight, and asked if I could have a reduction on my mortgage payment that month.

How the hell did you get your bank manager's number? They're impossible to get hold of in my experience :bouncy:

If it's not due to the client's non-adherence to the terms and conditions (this includes ensuring adequate supervision of guests) then I offer a pro-rata refund. No-one's fault (a fire, for example), so offering a refund would be fair in the eyes of the law.

 

Any other reason, i.e., if the client simply decides to terminate the gig for whatever reason, there will be no refund.

My contract states : Performance : Commencing (start time) and then as required, finishing no later than (finish time). so again, if the party finishes early as in the original post, I would not offer a refund.

 

There are obviously a few reasons where I might consider giving some kind of refund, a power cut for example, but that would be decided on each particular event.

Do Doorstaff give a refund if there ISN'T a fight or trouble to deal with on a particular night?

 

Do Barstaff get paid less if the pub has a quiet night?

 

Do teachers take a cut in pay and offer the tax payer a refund if one of their pupils fails to pass exams?

 

You took a night out of your life on their behalf in order to do a job and earn a living, you honoured your side of the contract by turning up and delivering the service has agreed. I'm guessing that you didn't instigate or get involved in the trouble, so why should you be responsible for the early finish?. Do you know if the venue offered a pro-rata refund too?

 

Their choice of guests = their problem

 

If you don't have already, get some protection in your contract stating that you will not be responsible for issuing or considering refunds in the event of circumstances beyond your control. Some popular examples,

 

1) Earlier events over running - you turn up at 7pm as agreed on the booking form, but the venue or client tell you that you can't set up yet because the guests were late arriving and they've only just sat down to their wedding breakfast.

 

2) Acts of god - for example bad weather, instructions by the Police or Highways agency not to use a road because of snow / flooding

 

3) The venue management or emergency services ask you to cease performing or to evacuate the building for whatever reason.

 

4) Power Failure

 

Its also a good idea to stipulate that decisions made by the venue management whilst both client and artiste are on the venue premises over-ride any agreement on the booking form. The venue management DO have the legal power to refuse entry and to ask any person to leave their private property at any time they choose, including the DJ!. This pretty much covers you against situations where the venue management may request that you cease playing earlier than you and the client agreed, whether its because their license hours differs from what the client THOUGHT they could play until or whether a fire, bomb scare or violence / damage incident requires the venue to evacuate the guests early.

back on topic, i wouldnt have a problem keeping the 8-12 money, the dilemma was the extra hours overtime for instance £80 which wasnt provided. After this happened i had a huge guilt pang, the main lady was in tears, her mother was crying, kids were upset etc and im there packing down with an extra £80 for doing nothing!

If I gave cash back for early finnishes for fights breaking out i,d be living in a tent now.dont foeget most of my gigs are in Middlesborough and its unusual if your wedding see's it to the end without a fight,ambulance or murder.

I wouldn't refund anything either. Just explain that you've scheduled your weekend around a late finish (i.e. you can't do an early gig/hire/shopping run the next day) so it still has to be paid for.
