Yes - you'll need written agreement from the copyright holder to be legal. Most deal with the PRS/MCPS, who manage this admin on their behalf, and collect royalties from the use of their music...

If you're putting a popular music track on your website, you will need pay money, and also comply with their rules (so you can't simply put the MP3 on your site - it needs to be streamed, so people cannot link/download the file).

 

These guys do employ companies to comb the web, looking for audio tracks on website - and fire off scary letters.

A few years ago I found a robot that kept visiting one of my sites (fully legit online store, selling fossils!), and the company was one employed to spider sites looking for media.

 

Not sure if the spider obeyed "no follow" meta tag...

 

 

Best to contact them direct for advice if this is something you really want to do.

 

Kind of related, I did find a place where you can purchase a license to put music into video (ie, create a DVD with commerical soundtrack). I think it was about £5/license, and each license came with a nice hologramed sticker... Not too bad a price to be legally adding that 1st dance track to any photos/videos you took during a wedding!

Looks a pain to do right. You'll need to provide reporting, and also ensure visitors do not download the entire track (for their future use).

 

As I said - best to call them for advice.
